Today, we would like to talk to those of you that have decided to stop making payments and are considering a short sale. If you have decided to stop making payments or you are running out of money, the bank will be calling or has by now started calling to collect.
There are several things you should understand if you are in this position. You are not by yourself in this situation. You don’t have to speak to the lender collectors. There is in fact a law called the Fair Debt Collections Practices Act that gives you rights in this situation. If you notify your lender in writing that you do not want to be contacted, legally your bank can not contact you via telephone. This is one way to stop the phone calls.
We would encourage you to speak to the bank one time and let them know that you are working a short sale or a loan mod. AFter that one contact, don’t speak with the bank again. Those people are merely going to wear you down.
